CANADA WILL JOIN THE MADRID PROTOCOL CONCURRENTLY WITH THE IMPLEMENTATION OF NEW TRADEMARK LAW ON JUNE 17, 2019

On March 17th, the World Intellectual Property Organization (WIPO) received the instruments of accession from Canada to the Madrid Protocol which will enter into force on June 17, 2019 when its new national trademark law takes effect. Canada will be the 104th member of the Madrid Protocol. The new national law will, inter alia, remove the requirement of a filing basis, reduce the registration term from 15 to 10 years, and in many ways, broaden the grounds available to seek expungement (ie, summary cancellation) of a registration.
